Under the first compliance order, Alberts had been ordered to file his 2003 and 2004 individual income tax returns along with the 2004 corporate income tax returns for his companies, 052560 N.B. Inc. and Dick Alberts Publishing Ltd., and the 2004 and 2005 corporate income tax returns for his other business, Multi-Publicity N.B. LTD/LTEE. Under the second compliance order, Alberts had been ordered to file GST/HST returns for Multi-Publicity N.B. LTD/LTEE for the period between May 2005 and January 2006.

On May 24, 2007, Alberts was fined $10,350 after being convicted on nine counts of failing to file tax returns. The Court ordered that he file all of the missing tax returns by August 24, 2007. Failing to comply with the court imposed order resulted in these latest charges being laid.

In addition to the $2,400 fine, the Court issued an order of compliance to Alberts to file the returns by July 18, 2008, and to pay the fine within six months or serve 21 days in jail.
